Article 1: Definition

The terms used in these general terms and conditions of sale will have the meaning given to them below:

Buyer: natural person acquiring Products through the Site

Seller: Ambergris Europe

Products: Items offered for sale on the site, for example, raw materials for perfumery, incense and accessories.


Article 2: Scope of Application and Modification of the General Terms and Conditions of Sale

2.1 The purpose of these General Terms and Conditions of Sale is to define the rights and obligations of the Parties in the context of the online sale of products and services offered by the Seller to the Buyer.

2.2 These general terms and conditions of sale apply only to all orders

placed on our website www.sultansiak.com

2.3 The company Ambergris Europe reserves the right to modify these

general terms and conditions of sale. In the event of modification, the general terms and conditions of sale in force on the day of the order will be applied to each order.

2.4 These general terms and conditions express the entirety of the obligations of the parties. In this sense, the consumer is deemed to accept without reservation all of the provisions set out in these general terms and conditions. No general or specific condition appearing in the documents sent or delivered by the consumer may be incorporated herein, since these documents are incompatible with these general terms and conditions.


Article 3: Products and validity of the offer

3.1 The products presented by the Seller are available within the limits of actual stocks at the time of the order.

3.2 The “Made To Order” offers are available subject to acceptance of the order by the manufacturer.

3.3 The descriptions and photographs available on the Seller’s website are as accurate as possible. However, slight variations may be noted without the Seller being held liable or the validity of the sale being called into question.

3.4 When confirming the order, the Seller checks the availability of the products in stock. In the event of unavailability, the Seller undertakes to offer an exchange or refund within 30 days.

Article 4: Prices
4.1 The prices indicated are inclusive of all taxes (V.T.C.), excluding participation in processing and shipping costs.

4.2 The Seller reserves the right to modify its prices at any time and undertakes to respect the prices indicated at the time of the order, subject to the availability of the products.

Article 6: Validation of orders

6.1 The Buyer reads and adheres without reservation to the general conditions of sale and their terms prior to the validation of the order.

6.2 The Buyer undertakes to provide accurate data and information in good faith in the online forms accessible from the site.

6.3 The Seller reserves the right to contact the Buyer to verify or confirm the information provided. The provision of this information is one of the conditions for validation of the order. The Buyer therefore undertakes to provide a valid email address and telephone number when completing the order form.

6.4 In certain cases, particularly for non-payment, incorrect address or any other problem related to your account, the Seller reserves the right to suspend the order until the problem is resolved.

Article 7: Orders and Deliveries

7.1 Packages are delivered by post or by an independent carrier to the address indicated by the Buyer when ordering.

7.2 Delivery costs are included in the total to be paid for your order depending on the option chosen and the amount of the order.

7.3 The Seller undertakes to process orders within 5 days from the day following validation of your order.

7.4 Delivery times are expressed in working days from the date of leaving our warehouses, displayed for information purposes only. Exceeding this period does not give rise to any right to damages.

7.4 bis Delivery times are indicated when ordering. These are indicative times, expressed in working days and corresponding to the average processing and delivery times.

The Buyer acknowledges that, in the event of a Pre-order, the delivery time may be extended. The estimated delivery time is shown on the product sheet at the time of purchase. The delivery time depends on the time required and the production volume of all pre-ordered products.

The Seller cannot be held responsible for the consequences of a delay in delivery that is not its fault or is due to an act of force majeure.

7.5 In the event of failure to deliver due to the carrier, the Seller undertakes to reship all or part of the order within the limits of these general terms and conditions of sale.

7.6 The Buyer must check the conformity and condition of the items delivered at the time of delivery and before signing the carrier's delivery note. This check is considered to have been carried out once the buyer or a person authorized by the latter has signed the order form.

7.7 If at the time of receipt, the Buyer notices an anomaly on the packaging, that it is torn or damaged, he must check the condition of the products. If the latter are damaged, the Buyer must refuse delivery and indicate on the delivery slip "Package refused because opened or damaged".

7.8 The information requested from the consumer is necessary for processing his order and may be communicated to the contractual partners of the company Ambergris Europe involved in the execution of this order.

Article 8: Right of withdrawal and return

The Buyer has a period of 14 days from the delivery of the products to change his mind and return the goods to us, and receive a full refund of the purchase. For any refund request, the return costs (for returning the products) will be borne by the Buyer.

The Buyer is responsible for the proper delivery of the products in the context of a return.

 

> Free exchange (in metropolitan France)

The Buyer may decide to exercise his right of withdrawal within 14 days from receipt of the order. The Buyer must notify the Seller of his wish to exchange his product within the time limit by e-mail to the address: seb@sultansiak.com

The Seller will send by return e-mail a prepaid return label to print and stick on the package. The Buyer will then drop off his package at the Post office of his choice.

The package must be carefully prepared by IMPERATIVELY inserting the delivery note. If the Buyer has lost it, please contact the Seller.

If the Buyer resides outside metropolitan France, he will not be able to receive a prepaid return label. He will have to pay for the return of the package himself to the service provider of his choice by specifying the return address as follows:

Upon receipt of the package, product control and computerization of the latter by the warehouse, the Seller may proceed with the exchange of the product concerned.

If the product is available, it will be returned free of charge in mainland France to the Buyer. If the Buyer is located outside mainland France, the product will be returned subject to delivery costs, the same as those requested from the Buyer when ordering. The amount will be requested by the Seller via email from the Buyer and paid using a payment link.

All shipments and returns after the first exchange will be chargeable to the Buyer based on the scale applied for an order.

> Refund

The Buyer may decide to exercise his right of withdrawal within 14 days of receipt of the order. The Buyer must notify the Seller of his wish to exchange his product within the time limit by e-mail to the address seb@sultansiak.com

The Seller will send by return e-mail a prepaid return label to be printed and stuck on the package. The Buyer will then drop off his package at the Post Office of his choice.

Please note that the amount of the return label will be deducted from the refund of the Buyer's order.

If the Buyer resides outside mainland France, he will not be able to receive a prepaid return label. He will have to pay for the return of the package himself to the service provider of his choice, specifying the return address as follows:

Refunds are made within 30 days of receipt of the returned products.

The Seller reminds that returned products must be new, never worn (except for short fittings) and in their original box, perfectly intact (packaging and accessories). Only intact products, i.e. in their original condition (in their packaging and unopened), will be accepted.

Upon receipt of the package, the Seller will judge the perfect condition of the returned goods. No exchange or refund will be accepted if the returned products have been visibly used or damaged by the Buyer and this use or damage makes the items unfit for sale. If the exchange or refund is refused, the products will then be returned to the Buyer. The return costs will therefore be borne by the Buyer.

In accordance with article L121-21-8 of the Consumer Code, the following are excluded from the right of withdrawal: periodicals and magazines as well as goods made according to the consumer's specifications or clearly personalized

Products in the "incense sticks" categories and all products marked "Made to Order" cannot therefore be returned.

Article 9: Indivisibility of these general terms and conditions of sale

9.1 If one or more provisions of these general terms and conditions of sale are held to be invalid or declared as such pursuant to a law, regulation that would be applicable to them, or following a final decision of a competent court, the other provisions will retain all their force and scope.

 

Article 10: Jurisdiction

10.1 These General Terms and Conditions are subject to French law for both substantive and formal rules. In the event of a dispute, the Buyer will, before taking any action, contact the Seller in order to find an amicable solution.
